How Do Bail and Bail Bonds Work?
When a person is suspected of committing a crime, he is arrested and taken to the nearest jail where he is booked. Booked just means putting the defendant as an entry into the police records, which means the defendant will be photographed, fingerprinted, searched for weapons, drugs and other contraband, and asked all sorts of questions to determine if he will be charged. If he is charged, he must remain in jail until his first court hearing (arraignment). While waiting for his arraignment, he can get out of jail if he posts bail. The bail will be returned to the defendant after the case is concluded. The defendant will be allowed to make one phone call to a friend or relative who is able to post bail or able to contact a good bail bond agent.
Bail is set by the judge and is based on the schedule of bail in California – a list of crimes and their corresponding bail amounts. This amount can also be influenced by the defendant’s community standing, lack of criminal history, severity of the crime, or whether he has a family or a job.
Bail bonds take the place of bail and is posted by the bail bond agent in behalf of the defendant. If the defendant cannot pay the full premium at one go, the bail bond agent usually prepares a payment plan so the defendant or his co-signer can pay the premium in staggered amounts.
What If I Don’t Show Up At Court?
If you are the defendant and you flee your bail and you posted bail through a bail bond agent, your co-signer will be made liable for paying the full amount of the bail to the bail bond agent. In addition, the bail bond agent (or your co-signer) may hire a bounty hunter to find you, arrest you, and bring you back to court – adding more legal expenses to your co-signer.
If you paid the bail in full, your cash (or property as collateral) becomes the property of the court.
