How Do Bail and Bail Bonds Work?
When a person is arrested for a crime and taken to the nearest jail (in the City of Santa Clara, that would be the City Jail’s Temporary Holding Facility at 601 El Camino Real or any of the detention centers in the surrounding areas) where he is booked. Booking means creating or updating a defendant’s police records. Booking includes taking photographs, fingerprints, searching for and noting down and keeping weapons, and other items in his possession. The defendant will also be asked all sorts of questions so that the police may know if they will charge him or not for an offense.
If the defendant is charged, he must remain in jail until his arraignment. He can get out of jail before his arraignment if he posts bail. The bail will be returned to him after the case is tried. To post bail, he will be allowed to make one phone call to a friend, usually a loved one, who is able to post bail.
Bail is set by the judge and is based on the California Bail Schedule – a list of crimes with their corresponding bail amounts. This amount can also be lessened (or waived) if the defendant has good community standing, no criminal history, if the crime is not serious, and whether he has a family or a job. If the bail is too high for the defendant or his loved one to pay at one step, he may need the services of a bail bond agent.
A bail bond in California takes the place of bail and is posted by the bail bond agent in behalf of the defendant. Before posting a bail bond (commonly a surety bond), the bail bond agent enters into a contract with the defendant together with the defendant’s co-signer, usually a friend or family member of the defendant who takes responsibility for the defendant attending his court hearings from the time he is released on bail. After the contract is signed, the defendant or co-signer pays the bail bond agent 10% of the bail as premium – a non-refundable fee for the agent’s services. The premium can be lowered to 8% if the defendant is a veteran, an active military member, a union member or if he retained an attorney.
If the defendant cannot pay the full premium at one go, the bail bond agent usually prepares a payment plan so the defendant or his co-signer can pay the premium in staggered amounts.
What If I Don’t Show Up At Court?
If you are the defendant and you posted bail through a bail bond agent and you flee your bail, your co-signer will be made liable for paying the full amount of the bail to the bail bond agent. In addition, the bail bond agent (or your co-signer) may hire a bounty hunter to find you, arrest you, and bring you back to court – adding more legal liabilities for your co-signer. If you paid the bail in full, your cash (or property as collateral) becomes the property of the court.
